Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Creatoro ("we", "our", "us"), governing your access to and use of the Creatoro platform available at creatoro.io.

By creating an account or using any part of our service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use Creatoro.

We reserve the right to update these Terms at any time. Material changes will be communicated via email or an in-platform notice. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.

Creatoro is an Instagram automation platform designed for creators and businesses operating Instagram Business accounts. Our platform provides:

Automated DM replies triggered by post comments or direct messages; automated comment responses; post scheduling; a CRM for managing contacts and followers; and Instagram analytics dashboards tracking metrics such as followers, reach, impressions, and engagement.

The platform connects to Instagram via the Meta Graph API. All automation operates within the boundaries of Meta's platform policies and API permissions.

To use Creatoro, you must:

Be at least 18 years of age, or the age of majority in your jurisdiction, whichever is greater.

Own or have authorised access to an Instagram Business or Creator account. Creatoro does not support personal Instagram accounts that have not been converted to Business or Creator status.

Comply with Meta's Terms of Service and Community Guidelines at all times. Your Instagram account must remain in good standing with Meta throughout your use of Creatoro.

Provide accurate, current, and complete information during registration and keep your account details up to date.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to use Creatoro solely for lawful purposes and in a manner consistent with these Terms, applicable law, and Meta's platform policies. The following uses are expressly prohibited:

No spam or unsolicited mass messaging:You must not use Creatoro to send bulk, unsolicited, or repetitive DMs to users who have not engaged with your content or otherwise indicated interest. All automated messages must be directly triggered by a user's own action (e.g., commenting on your post).

No policy violations:You must not configure Creatoro to send content that violates Meta's Community Standards, Instagram's Terms of Use, or any applicable law, including content that is hateful, harassing, misleading, or fraudulent.

No scraping or circumventing rate limits: You must not attempt to use Creatoro to scrape Instagram data outside of what is provided by the official Meta Graph API, nor attempt to circumvent API rate limits or access controls.

No unauthorized access:You must not attempt to access any part of Creatoro's systems, infrastructure, or other users' accounts beyond your authorised access.

No reverse engineering: You must not decompile, disassemble, reverse engineer, or attempt to extract the source code of any part of the Creatoro platform.

Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund.

Creatoro offers a free tier and paid subscription plans billed in US Dollars (USD). All payments are processed securely through DodoPayments. By subscribing to a paid plan, you authorise DodoPayments to charge the applicable subscription fee on your selected billing cycle (monthly or annual).

Billing cycle: Subscriptions renew automatically at the end of each billing period (monthly or annual) unless cancelled before the renewal date.

Price changes:We reserve the right to change subscription pricing. We will provide at least 30 days' notice before any price increase takes effect on your account.

Refund policy: All subscription fees are generally non-refundable. Refunds may be granted at our sole discretion in exceptional circumstances. If you believe you are entitled to a refund, contact us at legal@creatoro.io within 7 days of the charge in question.

Taxes: Prices displayed may be exclusive of applicable taxes such as GST. Any applicable taxes will be displayed at checkout and are your responsibility.

Failed payments: If a payment fails, your account may be downgraded to the free tier or suspended until the outstanding balance is resolved.

Your content: You retain all intellectual property rights in the content you create, including posts, DM templates, and creative assets you upload to Creatoro. By using the platform, you grant us a limited, non-exclusive licence to access and process your content solely to the extent necessary to deliver the services you have configured.

Our platform: All rights in the Creatoro platform, including its design, code, features, trademarks, logos, and documentation, are owned by or licensed to Creatoro. Nothing in these Terms grants you any right, title, or interest in the platform beyond the limited right to use it as described herein.

Feedback: If you provide suggestions, feedback, or ideas about the platform, you grant us a perpetual, irrevocable, royalty-free licence to use that feedback in any manner without obligation to you.

We strive to maintain high availability of the Creatoro platform, but we do not guarantee uninterrupted or error-free operation. The service is provided on a best-effort basis. Scheduled maintenance, updates, or circumstances beyond our control (including Meta API outages or changes) may cause temporary unavailability.

Free-tier users are not entitled to any service level agreement (SLA). Paid plan users may contact support for assistance, but no formal uptime guarantee is offered unless expressly stated in a separate written agreement.

We are not responsible for any disruption to the service caused by changes to Meta's Graph API, changes to Instagram's platform policies, or any action taken by Meta against your Instagram account.

By you: You may close your account at any time through the account settings page. Upon closure, your data will be deleted in accordance with our Privacy Policy.

By us: We reserve the right to suspend or terminate your account immediately, without notice, if we determine that you have violated these Terms, our Acceptable Use Policy, or applicable law. We may also terminate inactive free accounts after 90 days of inactivity, with reasonable prior notice.

Upon termination, your right to use the platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will continue to apply.

To the maximum extent permitted by applicable law, Creatoro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of or inability to use the platform.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the services shall not exceed the total amount you paid to us in the 3 months immediately preceding the event giving rise to the claim.

These limitations apply regardless of the form of action, whether in contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

The Creatoro platform is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the platform will meet your requirements, that it will be uninterrupted, timely, secure, or error-free, or that any errors will be corrected. Use of the platform is entirely at your own risk.

These Terms are governed by and construed in accordance with the laws of India, specifically the laws of the State of Rajasthan, without regard to its conflict of law principles.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts located in Rajasthan, India.
